The purchase of any ticket implies the express, full, and unreserved acceptance by the customer of each and every one of the conditions set forth here, as well as the Internal Rules and Safety Regulations of the facilities. These conditions will have an indefinite period of validity and will be in force for all contracts made through this portal.

3. Purchase Process and Booking Channel (Channel Manager)

3.1. Booking Procedure

The sale and booking of tickets is technically managed through the integrated external platform TuriTop, which acts as our booking engine and Channel Manager. The user must select the date, time slot (if applicable), and the number of tickets they wish to purchase, and must complete the mandatory identification fields (name, surname, email, and phone number) required for the correct issuance of access confirmation codes.

3.2. Confirmation of Contract

Once the purchase process has been successfully completed and payment validated, the TuriTop system will automatically send a confirmation email to the address provided by the user. This email will contain the confirmation code, QR code, or ticket receipt, which will constitute the only valid document for physical access to the pool facility. It is the sole responsibility of the user to check their inbox (including the spam or junk mail folder) and keep this document for presentation at access control.

4. Pricing and Payment Gateway

4.1. Prices and Taxes

The prices applicable to each type of ticket will be those published clearly and transparently on the website at the time of purchase. All prices are expressed in Euros (€) and include the Canary Islands General Indirect Tax (IGIC) or Value Added Tax (VAT) as applicable according to current tax regulations. The company reserves the right to modify its rates at any time, always guaranteeing the user the price in effect at the time of booking confirmation.

4.2. Secure Payment Gateway (Redsys)

Electronic payment for tickets must be made by credit or debit card through the secure payment gateway of Redsys (Virtual POS provided by the banking institution). To guarantee maximum security and confidentiality in payment transactions:

The entire payment process is carried out in an encrypted web environment using SSL (Secure Socket Layer) protocol.

Banking and card data travel directly in encrypted form between the user’s device and the Redsys financial server.

Construcciones J.P. Fulda S.A. does not store, record, or have access under any circumstances to customers’ credit or debit card data.

5. Cancellation, Modification, and Refund Policy

In accordance with the provisions of Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the right of withdrawal will not apply to contracts for leisure services or recreational activities if the contract provides for a specific date or period of performance. Consequently, cancellations and refunds will be governed strictly by the following commercial policy:

Cancellations with more than 24 hours’ notice: Requests for cancellation or modification of ticket bookings communicated to the company with a minimum of 24 hours’ notice prior to the reserved date will be processed completely free of charge. The customer will be entitled to a full refund of the amount paid or, if preferred and subject to availability, to change the date of their tickets.

Cancellations with less than 24 hours’ notice or no-show: Cancellations, withdrawal requests, or modifications communicated with less than 24 hours’ notice prior to the date and time of the booking, as well as failure to appear at the facility on the reserved day, will not entitle the customer to any type of refund, reimbursement, or date change. The service will be considered fully rendered due to the blocking of the space in the limited capacity of the facility.

6. Opening Hours and Lifeguard Service

Official Hours: The opening and closing hours of the recreational pool facilities and the corresponding mandatory lifeguard service are from 10:00 AM to 6:00 PM.

Prohibition of Presence Outside Hours: Swimming, remaining, or staying by any user inside the pool basin, as well as in its surrounding deck area, outside the indicated operating hours is strictly prohibited. Outside this time slot, the lifeguard and surveillance service is suspended, and the company declines any responsibility for incidents occurring in case of unauthorized access or violation of this rule.

7. General Rules of Use, Hygiene, and Safety of the Facility

The purchaser of tickets and any user accessing the facilities accepts in a binding manner strict compliance with the operational guidelines detailed below. The company’s control staff will ensure their strict enforcement:

  • Legal Technical Capacity: Due to strict health, safety, and hygiene criteria established by regulations for collective-use pools, the maximum authorized capacity in the pool basin is limited to a maximum of 200 people simultaneously. Once this instantaneous occupancy limit is reached, no more bathers will be allowed to enter the water, even if they have a ticket for the facility, until vacancies occur.
  • Mandatory Hygienic Footwear: The use of specific bathing sandals (flip-flops or pool shoes) in the common area of restrooms, changing rooms, and communal showers is completely mandatory and essential. Walking barefoot in these areas is prohibited to prevent health risks and falls.
  • Supervision and Protection of Minors: Children and minors accessing the facility must be permanently accompanied, monitored, and under the constant and uninterrupted supervision of a responsible adult at all times. The presence of lifeguard staff at the facility has rescue and general surveillance functions, but in no case replaces the duty of care and supervision of parents, guardians, or caregivers of minors.
  • Prohibition of Animal Access: The entry of animals or pets of any kind to the pool facility is strictly prohibited, with the sole and legitimate exception provided by law for officially accredited and certified assistance dogs and guide dogs accompanying people with functional or visual disabilities.
  • Mandatory Health and Hygiene Measures: It is strictly mandatory for all users to shower completely in the perimeter showers before entering the pool basin. Likewise, throwing any type of waste or litter on the ground is prohibited; users must make mandatory use of the bins distributed throughout the facility to maintain the health and cleanliness of the public space.
  • Sound Equipment and Rest: The use of music players, portable speakers, instruments, or sound devices that emit noise at a volume that may disturb, annoy, or disrupt the tranquility and well-being of other users in the rest and sunbathing areas is prohibited.
  • Flotation Devices and Inflatables: It is expressly prohibited to bring in and use giant air mattresses, large recreational floats, or bulky water toys in the water. These items reduce the lifeguard’s visibility in risk situations and reduce the safe bathing space for other users.
  • Water Safety, Diving, and Depth: Diving headfirst into the pool, performing dangerous jumps, acrobatics, or running on the wet edge of the perimeter is strictly prohibited. Users must be aware of the depths of the basin: the maximum depth is 1.00 meter for the general adult area and 0.50 meters in the designated children’s area.
  • Prohibition of Dangerous Materials: It is absolutely prohibited to bring in, consume, or use glass containers, glass bottles, earthenware, ceramics, or any type of sharp, fragile, or pointed material throughout the pool, deck, and sunbathing area, in order to prevent cuts and serious accidents.
  • Civic Behavior and Coexistence: Ball games, disruptive sports activities, or any violent, reckless, or uncivic conduct that disturbs peaceful coexistence or puts the physical well-being of others at risk is prohibited.
  • Emergency Procedure: In the event of any type of incident, indisposition, or accident at the facilities, users must immediately notify the lifeguard staff or company employees. The general public emergency and civil protection number available in the region is 112.

8. Right of Admission and Expulsion from the Facilities

Construcciones J.P. Fulda S.A. explicitly reserves the Right of Admission regulated by regional regulations. Likewise, authorized company staff is fully empowered to proceed with the immediate expulsion from the facility of any user who engages in any of the following conduct:

  • Entering with outside food to the facility or smoking at any point in the wet perimeter or sunbathing area.
  • Repeatedly violating any of the Hygiene and Safety Rules detailed in Section 7 of this document.
  • Displaying aggressive, violent, offensive behavior or showing clear signs of being under the influence of alcoholic beverages or narcotic substances, disrupting public order and common safety.
  • Expulsion for any of these reasons will result in automatic loss of the right to remain at the facility and will not entitle the user to any type of refund, compensation, or reimbursement of the ticket price.

9. Modification of Conditions

The company reserves the right to modify, update, or replace at any time these General Terms and Conditions of Sale, as well as commercial rates, opening hours, and technical capacity rules to adapt them to new legal requirements or business needs. Changes will be considered valid and immediately applicable from their publication on the website, affecting purchases made after such publication.

10. Applicable Law and Competent Jurisdiction

These General Terms and Conditions of Sale and internal regulations are governed in all their aspects by current Spanish legislation.

For the resolution of any dispute, litigation, or legal claim arising from the interpretation, compliance, or execution of these terms of sale, both parties voluntarily submit, with express waiver of any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the city of Santa Cruz de Tenerife, Spain, unless applicable consumer protection regulations imperatively establish a different jurisdiction.
